The livelihood of many professionals and their businesses often depend on securing and maintaining a professional license, certificate or approval. State and local agencies promulgate and implement an array of professional standards, monitor and audit licensee conduct, investigate complaints, and seek to impose discipline that can jeopardize a professional license. Although the agency often has the advantage because of its understanding and control of the intricacies of the subject matter and the specialized procedures in place for resolving disputes, our attorneys are equipped to effectively overcome that advantage and protect our clients’ investment in their professional licenses.
Investigations and Complaints
Our firm has represented professionals and businesses before Missouri boards and commissions in responding to investigations or complaints and working with the agency to protect the licenses of our clients. A representative sample of professionals we have represented includes physicians, pharmacists, dentists, architects and engineers, attorneys, nurses, mental health professionals, optometrists, insurance agents, insurance companies, real estate agents, brokers and appraisers, nursing homes, and other health care providers.
We work to ensure that investigations are conducted within the authority of the agency, and that the licensee is afforded all legal protections and rights they are due. Our firm has been successful in favorably resolving licensure issues, whether by helping to ensure no action is taken by the agency or settling matters at the early stages before formal action is taken.
Litigation
Our firm has successfully represented professionals before the Administrative Hearing Commission, circuit courts, appellate courts and the Missouri Supreme Court.
Certificate of Need
Our firm has represented hospitals and nursing homes in the approval of Certificates of Need and the transfer of rights under such Certificates. We have also represented clients in litigation regarding both the approval and denial of Certificates of Need.
