BB&D Secures Injunction Against Former Licensee’s Use of Trademarks

Blitz, Bardgett & Deutsch litigation attorney, Jason K. Turk, represented a large publicly-traded company that owns trademarks for footwear and apparel. BB&D’s client licensed limited rights to certain trademarks to a licensee. After the licensee failed to live up to its obligations under the license agreements, BB&D’s client terminated those agreements. The licensee refused to recognize the terminations or stop using our client’s brands to sell products. BB&D filed suit in federal court seeking an injunction stopping all use of the trademarks. The Court ordered an immediate and truncated seven-week discovery period followed by a hearing on the merits of the preliminary injunction. Missouri Court of Appeals Finds in Favor of BB&D Clients Demanding Open Access to Government Meetings

BB&D attorneys Robert D. Blitz, Christopher O. Bauman, and Jason K. Turk represented taxpayers who brought a class action against the St. Louis County Board of Equalization. The Board of Equalization determines property value disputes between the St. Louis County Assessor and taxpayers. The Board of Equalization argued that it is not subject to Missouri’s Sunshine Act - which requires governmental bodies to open their meetings to the public - when the Board is hearing and deciding taxpayer appeals. State Tax Commission Rules in Favor of Property Owners

St. Louis law firm BB&D civil litigation attorneys Chris Bauman and Jason Turk represented two property owners before the Missouri State Tax Commission, successfully arguing that the St. Louis County Assessor and Board of Equalization had overvalued commercial property. After an evidentiary hearing, the State Tax Commission agreed with BB&D’s expert evidence and found that the properties were overvalued by more than $1.6 million each, including a reduction of nearly 50% for one of the properties. St. Louis BB&D Law Firm Wins in Court of Appeals on Sanctions Issue

Blitz, Bardgett & Deutsch law firm prevailed before the Missouri Court of Appeals on a case relating to $83,000.00 in sanctions awarded to its client in relation to a successful judgment on an underlying fraudulent conveyance lawsuit. BB&D had already won a judgment for his clients in the amount of $2.8 million which was settled by the parties. The appeal involved whether a party who was granted a sanction award, prior to entering into a settlement agreement that was silent on the award, was entitled to the sanction payment, irrespective of the settlement agreement’s general release language.
