Court of Appeals Issues Permanent Writ in Favor of BB&D Client and Against Former St. Louis Rams on Arbitration Issue

St. Louis law firm, Blitz, Bardgett & Deutsch, on behalf of the Regional Convention and Sports Complex Authority (also known as the RSA), prevailed before the State Court of Appeals with respect to a trial court’s ruling concerning arbitration in a matter between the RSA and the former St. Louis Rams.  The RSA had previously filed suit against the Rams on an issue related to a training facility in St. Louis County. The trial court ruled that the matter should be resolved in arbitration and the RSA applied for a writ.  In its ruling, the Court of Appeals stated that the matter should proceed before the circuit court given the language in the contract, as BB&D argued.  [...]

St. Louis Law Firm BB&D Participates in Motion for Kids Toy Drive

St. Louis law firm Blitz, Bardgett & Deutsch participates in the Motion for Kids annual holiday toy drive.  Motion for Kids is a partnership project between the Bar Association of Metropolitan St. Louis, St. Louis Bar Foundation, St. Louis Blues, St. Louis Cardinals, St. Louis University, and the Isaac Bruce Foundation, serving over 2,000 underprivileged St. Louis children each year during the holidays, providing gifts and an annual holiday party.  This year BB&D sponsored 33 children, purchasing gifts off their holiday wish lists. BB&D Obtains Arbitration Award in Construction Dispute

BB&D litigation attorney, Aaron Sanders, represented a construction company involved in the design and construction of multiple branch offices for an out-of-state financial institution.  After expending substantial resources in the design of one of the branch locations and readying the project for construction, the project was abruptly terminated by the financial institution.  The financial institution refused payment of the expenses incurred by BB&D’s client, prompting BB&D to seek enforcement of the rights granted pursuant to an arbitration clause in the parties’ contract.  Following testimony from both parties in a day-long arbitration hearing, the arbitrator awarded BB&D’s client virtually all of its expenses incurred on the project and ordered the payment of costs and attorneys’ fees incurred by BB&D’s [...]

Eighth Circuit Court of Appeals Finds in Favor of BB&D Client in Landmark Case Involving International Child Custody under the Hague Convention

BB&D litigation attorney, Aaron Sanders, represented the mother of two minor children involved in a custody dispute with their Peruvian father.  After traveling to the United States with the consent of the Peruvian government to seek medical attention for her son battling a rare and aggressive eye disease, BB&D’s client married a United States citizen and refused to return her children to Peru.  After the District Court permitted BB&D’s client to remain in the United States with her two teenage sons, the Peruvian father appealed, arguing that the return of the children was mandated pursuant to international treaty under the Hague Convention.  Representing the mother on appeal before the Eighth Circuit, Mr. Sanders presented complex legal arguments never [...]

BB&D Obtains Summary Judgment Declaring St. Louis Payroll Tax And Other Ordinances Are Constitutional

Blitz, Bardgett & Deutsch law firm represented the Collector of Revenue for the City of St. Louis who was sued, along with the City, by two taxpayers who alleged that the Ordinance creating the City’s Payroll Tax and two redevelopment ordinances were unconstitutional.  The taxpayers asked the court to enjoin the Collector from collecting the payroll tax, which was enacted in 1988 after city voters approved it and generates nearly $40 million dollars in revenue annually for the City of St. Louis.  The redevelopment ordinances allowed two employers with offices in the city to recoup costs they paid to enlarge and renovate their offices in order bring more employees to work in the city.  The costs were [...]

Contractor Disqualification and Suspension Actions Resolved Favorably

St. Louis law firm Blitz, Bardgett & Deutsch represented a construction company which was: disqualified from bidding and participating on Missouri Department of Transportation projects; non-renewed in the MoDOT Disadvantaged Business Enterprise program; and suspended by the U.S. Department of Transportation Federal Highway Administration from participating in FHWA projects and all projects involving federal funds. A minority owner/worksite manager was accused of making unauthorized deviations from contract specifications and filing false information on contract compliance in relation to a contract on which the company was performing subcontract work. BB&D Represents Seneca Medical in $38 Million Nationwide Sale and Leaseback of 5 Commercial Properties
