BB&D Successfully Defends the Dismissal of Petition Against Carpenters Union

BB&D attorneys Robert Blitz and Aaron Sanders successfully defended the Kansas City-St. Louis Regional Carpenters Council on appeal from the dismissal of a lawsuit brought by a former business agent.   The lawsuit centered around allegations of wrongful termination implicating a complex area of federal law governing unions under the Labor-Management Reporting and Disclosure Act.  The plaintiff attempted to bring twenty-eight separate claims in the lawsuit.  Relying on their vast experience in both employment litigation and complex business litigation, BB&D secured the dismissal of all claims.  On appeal, the Missouri Eastern District Court of Appeals agreed with BB&D and affirmed the dismissal.

Blitz, Bardgett & Deutsch Wins $1.3 Million Arbitration Award For Construction Client

BB&D attorneys Robert D. Blitz and Jason K. Turk represented a design-build company in its breach of contract action against a subcontractor.  Our client brought the action after the subcontractor did not provide the workers or materials to complete its scope of work in compliance with the project’s schedule.  Our client had to supplement the subcontractor’s work with its own workers and contract with additional subcontractors to complete the work.  The subcontractor also was not paying its own sub-subcontractors and suppliers, and they filed liens against the project.  The subcontractor asserted its own claim against our client for more than $900,000. Thomas Limbrick has joined the firm’s St. Louis office as an associate and represents clients in a range of civil litigation, including business torts, class actions, employment disputes, and personal injury.  Prior to joining the firm, Tom served as a law clerk to Judge Ronnie L. White of the U.S. District Court for the Eastern District of Missouri and Judge Mary Rhodes Russell of the Supreme Court of Missouri.  Tom attended the University of Missouri School of Law and served as Managing Editor of the Missouri Law Review.

Missouri Supreme Court Rules in Favor of Blitz, Bardgett and Deutsch’s Rams Phone Records Subpoena

Fox 2 News and the St. Louis Post-Dispatch reported that the Missouri Supreme Court has ruled in favor of Blitz, Bardgett and Deutsch attorneys Bob Blitz and Chris Bauman’s subpoena to make four phone companies turn over the last eight years of phone records of the NFL and team owners, including Stan Kroenke, in St. Louis' lawsuit against the Rams. Bob Blitz and Chris Bauman Spearhead Flurry of New Rulings Against the NFL, Rams

Two appellate rulings in two days have found against the NFL, the Rams, Stan Kroenke, and other defendants in a lawsuit against them for wrongfully relocating the Rams away from St. Louis.  Recently the trial court allowed the plaintiffs to obtain the phone and text records of various defendants, and the defendants appealed that decision to the Missouri Court of Appeals.  That appellate court sided with the trial court, and BBD’s clients, and allowed the discovery of the phone and text records to proceed.  One day later, the U.S. Supreme Court ruled on a request by the Rams and by Kroenke to freeze the case in state court while the Rams and Kroenke continue to argue that [...]
