Robert Blitz and Chris Bauman represented all Respondents, a local municipality, and the members of the municipality’s board of aldermen, on a claim that a conditional use permit granted by the City should not have been granted. Petitioner’s claim that the decision to grant the conditional use permit was not made based on competent and substantial evidence was brought in an effort to derail the entire multi-million dollar development. Although the ordinance granting the conditional use permit was only passed on September 5, 2012, BB&D was able to secure an immediate trial and a Judgment was issued on February 26, 2013. Blitz, Bardgett & Deutsch law firm litigation attorneys Christopher Bauman and Jason Turk defended an employee against a former employer who sought damages and injunctive relief. Among other things, the former employer wanted damages and restrictions on BB&D’s client’s ability to contact customers that the employee had worked with during his previous employment. BB&D successfully argued for an initial Order that stated that the employee was free to contact all customers for the purposes of competing. Although the employer stated claims for breach of the Missouri trade secrets act, computer tampering violations, and tortious interference, all claims were dismissed without any payment to the former employer and with no restrictions on the employee’s right to employment. BB&D Attorneys Obtain Decision from Court of Appeals Finding Personal Guaranties Signed by Wife of Homebuilder/Developer were Invalid and Unenforceable

Blitz, Bardgett & Deutsch litigation attorneys represented Thomas Hughes, a St. Louis homebuilder and real estate developer, and his wife, Carolyn, in a suit brought by Frontenac Bank seeking approximately $3.6 million for the alleged breach of promissory notes and related commercial guaranties. At trial, the court ruled in favor of BB&D and found the personal guaranties signed by Carolyn Hughes invalid and unenforceable on the basis that they violated the Equal Credit Opportunity Act. ECOA is a federal law that prohibits banks from requiring a spouse to sign a personal guaranty under certain circumstances. BB&D Attains Dismissal in Arbitration Concerning Edward Jones Dome

The St. Louis Regional Convention and Sports Complex Authority was dismissed from an arbitration filed by The St. Louis Rams, LLC, pursuant to a Motion filed by Bob Blitz, Chris Bauman, and Jason Turk. In June of 2012, the Rams filed a Demand for Arbitration and Statement of Claim concerning how to improve the Edward Jones Dome to "first tier" status and named the Authority as a Defendant. BB&D filed a Motion to Dismiss on behalf of the Authority that argued that the issue to be submitted to arbitration did not concern the Authority and the Rams had not asked for, and could not ask for, any remedy from the Authority. St. Louis Law Firm BB&D Successfully Defends Physician’s License

The Court of Appeals has affirmed, without a published opinion, a decision of the Administrative Hearing Commission finding no cause to discipline the license of Dr. James Knight. One of Blitz, Bardgett & Deutsch's founding partners, Jim Deutsch, represented Dr. Knight before the Commission and the Court of Appeals. At depositions and at the hearing, BB&D's legal team objected to the lack of foundation and the hearsay nature of the Board’s proposed experts’ testimonies. The Commission sustained BB&D’s objections, found that the Board had not met its evidentiary burden, and found no cause to discipline Dr. Knight’s license.
