Court of Appeals Affirms Summary Judgment Obtained by the Blitz, Bardett & Deutsch Law Firm

In this case, the BB&D law firm represented a national design/build contractor, a prominent real estate developer and St. Louis County. BB&D civil litigation attorneys argued the case before the Missouri Court of Appeals, Eastern District. The plaintiff, a subcontractor, asserted a mechanics’ lien and claims under the public works bond statute. The claims exceeded $1 million. BB&D obtained summary judgment from the trial court in favor of the defendants it represented. On appeal, the Court of Appeals ruled in favor of BB&D clients on all issues. BB&D Attorneys Secure Stay For Design-Build Firm and Surety

Robert Blitz, Chris Bauman and Jason Turk helped a national design-build firm and a surety bond issuer quickly resolve a dispute with a subcontractor. The design-build firm had contracted with the United States for multi-million dollar construction projects in two states. A subcontractor on both projects sued for breach of contract and a Miller Act claim against the projects’ surety bonds. The subcontract included an arbitration provision for claims arising out of the project, but the surety company was not a party to the subcontract. Missouri Supreme Court denies Frontenac Bank’s Motion for Transfer in Frontenac Bank v. TR Hughes, et al.

The Missouri Supreme Court recently denied Frontenac Bank’s Motion for Transfer to the Missouri Supreme Court in Frontenac Bank v. TR Hughes, et al. As a result of this ruling, the decision obtained from the Missouri Court of Appeals by Blitz, Bardgett & Deutsch law firm stands. BB&D represented Thomas Hughes, a homebuilder and real estate developer, and his wife, Carolyn, in a suit brought by Frontenac Bank seeking approximately $3.6 million for the alleged breach of promissory notes and related commercial guaranties.
