BB&D attorneys Robert Blitz, Chris Bauman, and Aaron Sanders recently secured an appellate victory from the Missouri Eastern District Court of Appeals.  The lawsuit involved claims brought by a BB&D client against an insurance carrier for failing to provide a defense to previous litigation.  The trial court dismissed the claims, finding the insurance policy did not provide coverage.  On appeal, BB&D asserted nine points of error in the trial court’s dismissal, and the Appellate Court agreed with all nine points, completely reinstituting all of BB&D’s claims.

The victory continued a string of appellate cases handled by Blitz, Bauman, and Sanders in 2020.  In their previous two appeals, the trio successfully defended the trial court’s dismissal of claims brought against BB&D clients.  One case involved the dismissal of twenty-eight claims brought against the Kansas City-St. Louis Regional Carpenters Council.  The Court of Appeals affirmed the dismissal of each count.  In the other appeal, BB&D defended the trial court’s dismissal of claims brought against a client related to a foreclosure and non-judicial sale of development property.
