Bob Blitz and Chris Bauman Spearhead Flurry of New Rulings Against the NFL, Rams

Two appellate rulings in two days have found against the NFL, the Rams, Stan Kroenke, and other defendants in a lawsuit against them for wrongfully relocating the Rams away from St. Louis.  Recently the trial court allowed the plaintiffs to obtain the phone and text records of various defendants, and the defendants appealed that decision to the Missouri Court of Appeals.  That appellate court sided with the trial court, and BBD’s clients, and allowed the discovery of the phone and text records to proceed.  One day later, the U.S. Supreme Court ruled on a request by the Rams and by Kroenke to freeze the case in state court while the Rams and Kroenke continue to argue that [...]

Legislation Modifies Missouri’s Business Incentive and Worker Training Programs

SB 68 renames the Missouri Works Training Program to the “Missouri One Start Program,” which provides flexible funding for a company’s training costs associated with a new facility, expansion or retraining project.  Companies may utilize industry training funds to offset training costs for new products, new manufacturing processes, technological innovation, and productivity improvement.   Under SB 68, a company is no longer required to retain its current number of employees, instead becoming eligible by maintaining at least one-hundred jobs in the year preceding the application.

DED Rules Are Implementing Significant Changes to Missouri’s Historic Preservation Tax Credit Program

Rules promulgated by the Missouri Department of Economic Development (DED) significantly alter Missouri’s Historic Preservation Tax Credit Program (HTC). The emergency rules, which took effect March 30, 2019, implement Senate Bill 590 enacted during the 2018 legislative session. The rules are expected to become final during the second half of 2019.

BB&D Successfully Represents Family Limited Partnership in Dispute with Life Insurance Company

BB&D attorneys Bob Blitz and Jason Turk successfully represented a family limited partnership that was the beneficiary of a $2 million life insurance policy.  The partnership purchased the policy as part of the family’s estate plan and sued the life insurance company after it refused to reinstate the policy and pay the death benefit.  BB&D also brought suit against the insurance broker that assisted the client in obtaining the policy.  Although the client did not pay premiums on the policy for a period of over two years after moving locations and failed to send a change of address to the insurance company, BB&D filed suit in federal court on its behalf and obtained a large settlement in our [...]

BB&D Secures Regulatory Relief for St. Louis Home Builders Association

BB&D’s representation of the Home Builders Association of St. Louis and Eastern Missouri (“STL HBA”) resulted in a regulatory victory that will provide significant savings for homebuilders and homebuyers.  With more than 600-member companies, STL HBA members annually invest millions of dollars in water infrastructure donated to water utilities after the completion of a development.  Investor-owned water companies previously enjoyed a federal tax exemption for such infrastructure (known as “contributions in aid of construction or “CIAC”), but a little-known change in the Federal Tax Cut and Jobs Act eliminated this exemption.  Without relief from the Missouri Public Service Commission (PSC), this tax would have impacted developers, increasing the cost of every new home by thousands of dollars.  [...]

As part of the Tax Cuts and Jobs Act of 2017, Congress designated certain Qualified Opportunity Zones to encourage new investment in economically-distressed communities through tax incentives. Opportunity Zone investments are intended to infuse new capital, development and economic growth in such Opportunity Zones. To date, the U.S. Treasury Department has issued two sets of guidance and proposed regulations regarding this developing tax incentive.
