BB&D, on behalf of Kansas City Southern de Mexico, S.A. de C.V., obtained dismissal of a lawsuit on forum non conveniens grounds.  Sixty plaintiffs filed suit against KCSM and its parent corporations in St. Louis County.  Plaintiffs’ claims were related to a bus accident in Mexico in 2015.

The doctrine of forum non conveniens is a rarely applied doctrine, wherein a lawsuit can be dismissed in one forum where the facts of the case show it would cause substantial inconvenience to litigate it there.

The trial court concluded that Mexico, not Missouri, was the proper forum for Plaintiffs’ claims, and that trying the case in Missouri would be an undue burden on Missouri courts.  The court dismissed the case in its entirety.
